GP 14 - Hearing Tribunal Charter

  1. Establishment

    The Hearing Tribunal is pursuant to section 15 and 16 of the Act.

  2. Source of Authority 

    The committee is delegated authority from Council via Bylaw 3.

  3. Composition  

    3.1. A Hearing Tribunal shall comprise a minimum of four (4) members.

    3.2. A Hearing Tribunal shall include a minimum of 50% public representatives appointed by the Lieutenant Governor in Council under s.13(1)(b) of the Act.

    3.3. The balance of Hearing Tribunal shall be Registered Nurses appointed by Council to the membership list established in section 15 of the Act.

    3.4. Any committee member may serve as Chair.

    3.5. The Hearings Director shall designate a member of a Hearing Tribunal as Chair.

  4. Eligibility  

    4.1. Members must not currently be a member of the College Council or another College Regulatory Committee.

    4.2. Registrants shall meet the competence requirements defined by the Nominating Committee.

    4.3. Council is responsible for removal of registered members.

     

  5. Term  

    5.1. The term of office of Registrant members on the membership list is three (3) years, staggered with approximately one-third of these members appointed each year.

    5.2. All committee members may serve one (1) additional term.

    5.. A member continues to hold office after the expiry of the member’s term until the member is reappointed or a successor is appointed.

     

  6. Quorum  

    6.1. A quorum is four (4) members.

    6.2. A quorum must include a minimum of 50% public representatives.

  7. Meetings 

    7.1. All decisions shall be by a majority vote.

    7.2. If a Hearing Tribunal is sitting with an even number and there is a tie vote, then the Chair shall cast a second and deciding vote. 

    7.3. Subject to the Act, a Hearing Tribunal may determine its own rules respecting the calling of and conduct of its hearings, meetings, or the handling of matters within its jurisdiction.

  8. Duties and Powers


    A Hearing Tribunal may:

    8.1. Conduct hearings under Part 4 of the Act.

    8.2. Undertake any other power or duty given to it under the Act, the Regulations, or the Bylaws.

     

  9. Confidentiality

    9.1. Each member of a Hearing Tribunal shall keep information received by them as a member of the Hearing Tribunal confidential.

    9.2. Information given to the Hearing Tribunal shall be disclosed only in accordance with the Act, the Regulations, the Bylaws or as otherwise required by law.

    9.3. The Hearing Tribunal may authorize the disclosure of information for statistical use when
    the information cannot be attributed to a particular individual or facility.

    9.4. Disclose information given to the Hearing Tribunal in accordance with the Act, the Regulations, the Bylaws or as otherwise required by law.
