Bylaw 4: College Register

4.1. Register Categories

Categories of the regulated members register established by the Council are listed in section 2 of the Regulations.

4.2. Register Sub-Categories

The registered nurse register has the following sub-categories:

a) Virtual Care
b) Emergency
c) Non-practising former registrants

4.3. Virtual Care

4.3.1. The Virtual Care Sub-Category is established as a sub-category of registration in the Registered Nurse, Nurse Practitioner, Certified Graduate Nurse categories of the Register.

4.3.2. An applicant for registration as a registrant on the Virtual Care Sub-Category – Registered Nurse, Nurse Practitioner, Certified Graduate Nurse register may be registered on the Virtual Care Sub-Category register if the applicant:

4.3.2.1. is not a registrant of the College;

4.3.2.2. meets the requirements set out for Registered Nurses, Nurse Practitioners or Certified Graduate Nurses in Sections 3, 4, 5, 8 or 9 of the Regulations, as the case may be; and

4.3.2.3. meets the requirements set out in the Virtual Care Sub-Category policy approved by Council and published on the College's website, as may be amended from time to time.

4.3.3. Every registrant registered on the Virtual Care Sub-Category – Registered Nurse, Nurse Practitioner, Certified Graduate Nurse register may practise only from a jurisdiction outside of Alberta.

4.4. Emergency

4.4.1. The Emergency sub-Category of registration may be used at the discretion of the Registrar when the Chief Medical Officer of Health declares the existence of a public health emergency as defined in the Public Health Act.

4.4.2. The Emergency Registration Sub-Category is established as a sub-category of registration in the Registered Nurse category and Nurse Practitioner category of the Register

4.4.3. With respect to the Emergency Registration Sub-Category, the Registrar:

4.4.3.1. May establish an expedited process for registration;

4.4.3.2. Has the discretion to waive or reduce application fees for applicants; and

4.4.3.3. May waive the continuing competence requirements.

4.4.4. Applicants for the Emergency Registration Sub-Category must:

4.4.4.1. Have formerly been a registrant of the College; and

4.4.4.2. Meet the requirements for renewal of a practice permit set out in Section 21 of the Regulations.

4.4.5. Registration in the Emergency Registration Sub-Category is for a maximum term of three (3) months, which may be renewed once at the discretion of the Registrar.

4.5. Non-Practising Former Registrants

The College will maintain a register for non-practising former members with the rights, privileges and responsibilities of members on this register set out in the policies that came in effect on October 1, 2021

4.6. Registers and Records

4.6.1. The Registrar will continue the historical record and historical archive of every person registered as a registrant in alignment with the College's record retention schedule.

4.6.2. The registers established by the Act and these Bylaws may be maintained in a written record or by means of a computer record, or both.

4.6.3. A registrant or applicant for registration must provide the information specified at section 33(4)(b) of the Act and any other information about the registrant or applicant’s demographic status, education, training, experience, or professional practice considered necessary by the Chief Executive Officer and Registrar.

4.6.4. In addition to the information listed at section 33(3) of the Act, theChief Executive Officer and Registrar may enter in the register the year in which a registrant was initially registered as a registrant.

4.6.5. Except as required or permitted by the Act, Regulations, the bylaws or other legislation, no information collected by the College about a registrant in accordance with section 33 of the Act may be disclosed unless the disclosure is:

4.6.5.1. with the consent of the registrant whose information it is; or

4.6.5.1. in a summarized or aggregate form so that it is not possible to relate the information to any particular identifiable person.

4.7. Name to Be Used on the Register

4.7.1. For the purposes of the registers, the registrant must provide the College with their full legal name. “Full legal name” means a person’s first and last name and is the name:

4.7.1.1. set out on the person’s birth certificate or record of birth;

4.7.1.2. set out on the person’s certificate of change of name; or

4.7.1.3. the name taken by the person after they get married or divorced.

4.7.2. The Registrar may, at any time, verify the registrant's full legal name by requiring the registrant to provide proof of their full legal name in a form that is satisfactory to the Registrar. This may include: a driver’s licence, passport, permanent resident card, birth certificate, record of birth, certificate of change of name, marriage certificate or divorce certificate.

4.7.3. The registrant’s full legal name is the name that will appear in the register and on the registrant’s practice permit and must also be the name used by the registrant in their practice setting.

4.7.4. Notwithstanding article 4.7.3, a registrant may make a request to the Registrar to use a name other than their full legal name in the register, on their practice permit and in the practice setting. The Registrar may grant the registrant’s request if the Registrar is satisfied that extenuating circumstances exist.

4.7.5. If a registrant’s full legal name changes, they must inform the College of the change and, if the Registrar requests, provide proof of the change of name in a form that is satisfactory to the Registrar. This may include: a driver’s licence, passport, permanent resident card, birth certificate, record of birth, certificate of change of name, marriage certificate or divorce certificate.

4.8. Changes to Information

4.8.1. The Registrar may add to or remove information from any register of the College.

4.8.2. The Chief Executive Officer and Registrar may correct or remove any information in the register if the Chief Executive Officer and Registrar determines it is incorrect or inaccurate or add information required by the Bylaws or for proper administration.

4.8.3. No registration or practice permit will be cancelled except in accordance with the Act.

4.8.3. A registrant of the College may request access to the information on their record.

4.9. Determination of Residence

When it is necessary to determine the residence of a member for any purpose under the Act, Regulations or these Bylaws, the residence of the member will be considered for all purposes to be the address of the member recorded in the register unless otherwise provided in these Bylaws.

4.10. Application Date for Renewal of Annual Practice Permit

4.10.1. An annual practice permit expires on September 30th each year, unless otherwise provided for in the Act.

4.10.2. Each registrant must submit a complete application including fee payment and all information required by the Registrar under Section 40(1) of the Act and Section 21 of the Regulations, by September 30 of each year. The application must indicate whether the member is applying for a practice permit or for non-practising membership.

4.10.3. An application for renewal of an annual practice permit will not be assessed until it is complete as defined in article 4.10.2 above.

4.10.4. A reinstatement fee will be charged on any application for renewal of an annual practice permit received after September 30.

4.10.5. A registrant whose complete application as defined in article 4.10.2 above, is not received by September 30th, will have their practice permit suspended until they have met all outstanding requirements, and may have their registration cancelled pursuant to the Act.

4.11. Reissuing of Practice Permit, Reinstatement of Registration

4.11.1. A registrant whose practice permit and registration are cancelled only for non-payment of fees may have the practice permit reissued and registration reinstated in accordance with section 43(3) of the Act.

4.11.2. A registrant whose practice permit is suspended under Section 40(2)(c) of the Act may apply for the practice permit to be reissued (within the same practice year) by submitting to the Registrar a written application for reissuing of a practice permit, including a complete application as defined in article 4.10.2 above and evidence of meeting outstanding conditions on the preceding practice permit. The registrant’s practice permit may be subject to conditions, upon being reissued.

4.11.3. A registrant whose practice permit and /or registration are cancelled under Section 43(4) of the Act, may apply for the practice permit to be reissued and registration to be reinstated by submitting a complete application as defined in article 4.10.2 above, and a written application for reinstatement to the Registrar. The member’s practice permit may be subject to conditions, upon being reissued/reinstated.

4.11.4. A person who continues to provide nursing services as defined by the Act while their registration or practice permit is suspended, cancelled, or expired, is in contravention of legislation and may be referred to the Complaints Director or be subject to penalty according to the Act. If the registration is reinstated and/or a practice permit reissued, the registration and practice permit may be subject to conditions, and the contravention may be reported to the Complaints Director.

4.11.5. Notwithstanding clause 4.10.4, a person whose practice permit and registration are cancelled under Part 4 of the Act and who applies for reinstatement under Section 45.1 of the Act may be ordered by the Chief Executive Officer and Registrar or Registration Committee to pay any or all of the College’s expenses incurred in respect of the reinstatement application.

4.12. Fees

4.12.1. Council will establish fees for the following:

4.12.1.1. initial registration and registration renewals for each College register category;

4.12.1.2. initial registration and registration renewals for each College register virtual care sub-category;

4.12.1.3. initial practice permits and practice permit renewals for registrants; and

4.12.1.4. initial practice permits and practice permit renewals for each virtual care sub-category

4.12.2. Council may determine such other fees, dues, or levies as are required under the Act,
Regulations or these Bylaws or for anything it considers necessary for services provided to a registrant or any other person.

4.12.3. Council may establish policies that give direction to the Chief Executive Officer and Registrar in the setting of fees for recuperation of the costs and expenses associated with nursing education program approval.

4.12.4. If special circumstances arise requiring additional funding for the College, Council may impose a special levy against the registrants.

4.12.5. When fees, dues or levies are payable, notice of the fees, dues or levies payable will be sent to those registrants or persons required to pay them.

4.13. Professional Liability Protection

An applicant for registration as a registrant under Section 28 of the Act or for a practice permit under Section 40 of the Act must provide evidence of having beneficiary status with the Canadian Nurses Protective Society.

4.14. English Language Proficiency

4.14.1. An applicant for registration as a regulated member must be sufficiently proficient in English to engage safely and competently in the practice of the profession.

4.14.2. An applicant may be required by the Chief Executive Officer and Registrar or Registration Committee to demonstrate proficiency as required by article 4.1.4.1 in accordance with requirements approved by the Chief Executive Officer and Registrar.

4.15. Equivalent Jurisdictions

The following jurisdictions are recognized as having substantially equivalent competence and practice requirements for the purposes of section 28(2)(b) of the Act:

c. Manitoba

d. Ontario

e. Quebec

f. New Brunswick

g. Nova Scotia

h. Prince Edward Island

i. Newfoundland & Labrador

j. Yukon

k. Northwest Territories
